Three EXO members who are members of the EXO-CBX sub-unit, namely Chen, Baekhyun and Xiumin, decided to terminate their exclusive contract with management. Since this news was disclosed to the media on June 1, 2023, an exchange of arguments has taken place between the two parties.
SM Entertainment claims that their artists are influenced by outsiders with malicious intent. Management believes that Chen, Baekhyun and Xiumin are being used for the personal interests of these third parties. SM Entertainment also mentioned that the third party took advantage of a loophole in the management which was preparing a new vision.
They deliberately wanted to shake up the relationship between the agency and EXO-CBX, as well as between the other EXO members and Chen, Baekhyun and Xiumin. "There are those who take loopholes when we are concentrating on our ability to prepare for the new vision, they approach our artists and submit false information or incorrect legal assessments.
These parties say that it is okay to ignore the artists' exclusive contract and sign the contract. with them alone. It is certain that there are outsiders who make unreasonable suggestions to our artists," said SM Entertainment in their official release.
"These outsiders who have absolutely no interest in our artist, have carried out illegal actions that caused our artists to make erroneous judgments, decide to terminate contracts, or sign double contracts by taking advantage of rumors, slander, and persuasion," they continued. In response to this, representatives from EXO-CBX opened their voices.
Through Lee Jae Hak, the lawyer the trio chose, they confirmed that there was no involvement of a malicious third party as SM claimed. The lawyers actually want to underline that the EXO-CBX members are very mature to fight for their rights and choose a path that they have considered carefully.
The lawyer also requested that SM Entertainment not make false claims regarding EXO-CBX. Including attempts by third parties to use them to sign multiple contracts. In addition, it was also revealed the main reason why EXO-CBX terminated the contract with SM Entertainment.
Namely because the management is considered not to cooperate in terms of providing transparency regarding payments. "Even though the artist is given the payment data and consulted with the legal team, accountants, or anyone around them, this is an attempt by the artist to fight for their rights.
Even in the exclusive contract (with SM), there is no rule that says that the artist cannot show the payment report to another person or the obligation to only see the payment report itself. Precisely in the contract it is written that the artist concerned can review the data provided by SM Entertainment within 30 days, can also make appeals or changes if needed, "explained Lee Jae Hak.
"SM Entertainment didn't even provide payment data. Legal representatives and other artists have appealed to them to be fair in this situation. In the end, it cannot be denied that this raises questions about who should be criticized and who is at fault in this situation," continued the EXO lawyer -CBX.
